3.Instructing a Legal Representative

It is vital to the successful sale of your property to instruct an efficient and experienced legal representative. You will need to choose a solicitor or conveyancer to handle the legal work to transfer ownership of the property.

To ensure as few delays as possible, you should select your legal representative before you agree the sale of your house.

If you are buying another property alongside the sale of your existing one, it is a lot easier and more cost effective to use the same legal representative to handle both transactions.

4. Presenting Your Property

First impressions count, so it is important to present your property to maximise its impact with prospective buyers. The basic rules are to keep the property clean, de-clutter and de-personalise. A prospective buyer needs to visualise themselves living in the property rather than you.

Here are some suggestions for you to consider:

  • Reduce the number of personal effects such as photographs and ornaments.

  • Tidy up and remove any excess clutter from all rooms and the garden, where relevant.

  • Redecorate any areas that are looking tired

  • If there are any outstanding DIY jobs around the house, get them finished

  • Keep the bathroom as clean and tidy as possible. Make sure the bath, shower and sink are sparkling clean.

  • Bedrooms need to be kept tidy, with beds neatly made, clothes put away and the rooms left clutter-free.

  • Keep entrances or drives clear, removing items, such as bins, bikes or garden machinery.

  • Fresh flowers, tidy gardens and mown lawns (where relevant) also make a good impression.

In preparing the property for marketing we will arrange for our professional photographer and datographer to visit the property in order to take photographs and prepare the floorplan and property details.

The appointment is likely to take up to an hour and the tidier the property, the more time can be spent taking the photographs and drawing the floorplan.

Please bear in mind that we will be opening blinds and curtains and moving any objects that we feel necessary in order to make the property look its best but we will always endeavour to leave everything as we found it.

You could consider this your property's most important viewing. For example, the photographs taken during this appointment will be used to promote your property to a massive audience online and in print. It is therefore essential we work together to obtain the best photographs possible.

All property particulars are reviewed by a third party to make sure the information is accurate and the photographs appropriately reflect the quality of the property.

Once approved, the valuer review the details and will invite you, our client/vendor, to provide feedback and approve.

The property will be live on the internet within minutes of the approval process being completed and our extensive database is updated with the latest information in real time. (Rightmove will be updated usually within 24 hours)

5.Marketing Your Property

Today's buyers have access to a wide variety of media to gather information about available properties and often undertake considerable research before committing to a purchase.

6. Accompanied Viewings

We accompany viewings at all times and our experienced and fully trained staff will use their expertise to proactively sell your property.

7.Receiving An Offer

Harris Estates will notify you as soon as an offer is received. A senior member of our team will call you to discuss and the offer will also be confirmed in writing.

8. Agreed Offer

Having discussed an offer with our team, you will decide whether to accept or reject it.

At this stage, accepting an offer is not legally binding. If you accept an offer, a sale will be agreed, subject to contract, and confirmed to all parties.

We will arrange for your legal representative to send out a draft contract to the buyer's legal representative who will then raise local searches and raise various enquiries about your property.

If your buyer is arranging mortgage finance, a valuation inspection will be undertaken and the buyer will receive a mortgage offer once all income referencing and the valuation report have been satisfactorily completed.

Harris Estates will advise you and negotiate on your behalf throughout this process, including liaising with any third parties and keeping you informed every step of the way.

There are no binding legal obligations until contracts are exchanged.

9. Exchange of Contract

When you exchange contracts with the buyer you become legally committed to selling the property and they are legally committed to buying it from you.

Once the contract has been signed by both parties, the deposit (usually 10% of the purchase price) will be telegraphically transferred or paid in the form of a banker's draft by the buyer's legal representative to your legal representative.

If everything is ready (including any related transactions) a completion date will be agreed and set and contracts will be exchanged.

10. Completion

Completion is when the property legally changes ownership and will take place on the agreed date.

Your buyer will have paid the balance of the purchase price to your legal representative via their legal representative.

Once the formalities have been completed, the change of ownership will be registered at the Land Registry.

11. Moving Day

Completion day is when most purchasers will wish to collect the keys and move into the property which you have vacated.

You can move out whenever you like, even up until the day of completion. The least stressful option is to move out beforehand. At the time of completion, the property has to be in the condition agreed in the contract – including all the fixtures and fittings.

It is usually around lunchtime before the monies have moved through the banking system and Harris Estates will not release any keys to the purchaser until we have confirmation from your legal representative that it is OK to do so.
